Plaintiff Kelsey Martineau, who in 2013 and 2014 created work under the pen name Caspar Cole, alleges that Bungie lifted elements from a story he published on WordPress.com.<\/p>\n<p>\u201cDefendants have deliberately and intentionally copied the characters, storyline, and other protectable expression from Martineau\u2019s works in the Infringing Game,\u201d claims the suit filed on October 2, 2024. \u201cMartineau has never authorized or given consent for Defendants to use their copyrighted works in the manner complained of herein.\u201d<\/p>\n<p>Martineau\u2019s suit is aiming to halt the distribution of all content related to the storylines in question. The plaintiff is demanding a jury trial.<\/p>\n<p>The claim includes a laundry list of examples from both Martineau\u2019s work and Destiny 2 that the plaintiff  claims is proof of Bungie\u2019s wrongdoing. Included in each story are mentions of groups known as the Red Legion, with the suit pointing to character similarities between Destiny\u2019s Dominus Ghaul and Martineau\u2019s Overlord Yinnerah. The document goes as far as to say that both Red Legion factions \u201cmimic one another\u201d and that their \u201cgoals directly overlap.\u201d It also touches on broader narrative connections, suggesting that both works \u201cdetail the rise of a young and ambitious alien with the intent of dividing and conquering Earth in order to gain strategic asset(s).\u201d<\/p>\n<p>\u201cThe creators of Destiny 2 did not independently create their version of the Red Legion but instead of have wrongfully copied Martineau\u2019s original creation,\u201d the suit alleges.<\/p>\n<p>Bungie has yet to comment on Martineau\u2019s copyright infringement lawsuit. Meanwhile, the game developer continues to be surrounded by a tumultuous year of business that has seen it <a href=\"https:\/\/www.ign.com\/articles\/destiny-developer-bungie-cuts-220-staff-some-of-the-most-difficult-changes-weve-ever-had-to-make-as-a-studio\">shed hundreds of staff in layoffs<\/a> and <a href=\"https:\/\/www.ign.com\/articles\/destiny-2-set-for-major-changes-as-bungie-battles-to-win-back-players\">come under fire from fans<\/a>. Still, the team says it <a href=\"https:\/\/www.ign.com\/articles\/bungie-says-it-remains-committed-to-destiny-after-layoffs-will-reveal-plans-for-multi-year-journey-soon\">remains committed to Destiny<\/a> and has a \u201cmulti-year\u201d plan to keep its sci-fi journey chugging. In September, a former Bungie lawyer said <a href=\"https:\/\/www.ign.com\/articles\/sony-forcing-bungie-to-get-their-heads-out-their-asses-and-run-destiny-2-like-a-business-is-very-much-a-good-thing-studios-ex-lawyer-says\">Sony is \u201cforcing them to get their heads out of their asses.\u201d<\/a><\/p>\n<p>The Red Legion stems back to the early days of Destiny 2, which launched in 2017.
