Palworld<\/a> developer Pocketpair has provided an update on <\/strong>Nintendo and The Pok\u00e9mon Company\u2019s high-profile patent lawsuit against the company.<\/p>\n

According to Pocketpair<\/a>, Nintendo and The Pok\u00e9mon Company want 5 million yen (approx $32,846) each plus late payment damages, as well as an injunction against Palworld that would block its release.<\/p>\n

Pocketpair also confirmed the Japan-based patents, which revolve around catching Pok\u00e9mon in a virtual field, that it’s being sued for allegedly infringing. After Palworld\u2019s huge launch earlier this year on PC and Xbox, comparisons were made between Palworld\u2019s Pals and Pok\u00e9mon, with some accusing Pocketpair of “ripping off” Pok\u00e9mon designs. But rather than file a copyright infringement lawsuit, Nintendo and The Pok\u00e9mon Company have gone down the patent route.<\/p>\n

It is worth noting that Palworld does<\/em> include a mechanic that involves throwing a ball-like object (called a Pal Sphere) at monsters out in a field to capture them, similar to the mechanic seen in the 2022 Nintendo Switch exclusive Pok\u00e9mon Legends: Arceus<\/a>. One of the other patents in question is about riding on top of Pok\u00e9mon (Palworld also lets players ride Pals).<\/p>\n

Pocketpair said Nintendo and The Pok\u00e9mon Company are seeking an injunction against the game and compensation for a portion of the damages incurred between the date of registration of the patents and the date of filing of the lawsuit (September 18, 2024).<\/p>\n

Pocketpair has vowed to take on Nintendo and The Pok\u00e9mon Company in court, saying: \u201cWe will continue to assert our position in this case through future legal proceedings.\u201d<\/p>\n

Patent experts have said Nintendo and The Pok\u00e9mon Company\u2019s lawsuit against Pocketpair is evidence of the threat posed by Palworld<\/a>, which has since gone on to launch on PS5.<\/p>\n

In an article on GI.biz<\/a>, intellectual property expert and associate at law firm MBHB Andrew Velzen argued that the shock lawsuit shows \u201cjust how seriously Nintendo views the threat of Palworld.\u201d<\/p>\n

Palworld launched on Steam priced $30 and straight into Game Pass on Xbox and PC earlier this year, breaking sales and concurrent player number records in the process. Pocketpair boss Takuro Mizobe has said Palworld’s launch was so big that the developer couldn\u2019t handle the massive profits the game generated<\/a>.<\/p>\n

Still, Pocketpair acted swiftly to capitalize on Palworld\u2019s breakout success, signing a deal with Sony<\/a> to form a new business called Palworld Entertainment that\u2019s tasked with expanding the IP.<\/p>\n
